FTC fines Razer for misrepresenting COVID masks as N95s

A gaming lifestyle company that manufactured face masks for the COVID-19 pandemic has been ordered to pay up for allegedly playing its customers.

According to a complaint filed by the Federal Trade Commission on April 26, Razer misrepresented its line of Zephyr face masks as being N95 grade without ever being certified by the FDA or the National Institute for Occupational Safety and Health. Under a proposed settlement, the company would pay $1.1 million to provide refunds for customers in the US as well as a $100,000 civil penalty.

The FTC's complaint contains examples - from online statements from Razer's CEO to posts on Razer's social media accounts and website - describing the Zephyr as offering N95 or N95 grade capabilities since at least January 2021.

The FTC is also officially barring sales of the mask and "making COVID-related health misrepresentations or unsubstantiated health claims about protective health equipment." It goes a step further, "prohibit[ing] the defendants from representing the health benefits, performance, efficacy, safety, or side effects of protective goods and services (as defined in the proposed order), unless they have competent and reliable scientific evidence to support the claims made."
